§ 1 Introductory provisions

The Majoko online store, available at the internet addresses majoko.pl and majoko.eu, is run by Bartłomiej Mazurkiewicz, conducting business activity under the name Majoko Bartłomiej Mazurkiewicz, entered into the Central Register and Information on Economic Activity (CEIDG) run by the minister responsible for the economy, NIP 8652488003, REGON 147120486.

§ 2 Definitions

  1. Consumer - a natural person concluding a contract with the Seller within the Store, the subject of which is not directly related to his or her business or professional activity.
  2. Seller - a natural person conducting business activity under the name of Majoko Bartłomiej Mazurkiewicz, entered into the Central Register and Information on Business Activity (CEIDG) kept by the minister responsible for economy, NIP 8652488003, REGON 147120486.
  3. Customer – any entity making purchases through the Store.
  4. Entrepreneur - a natural person, a legal person and an organizational unit that is not a legal person, to which a separate act of law grants legal capacity, conducting business activities on its own behalf and using the Store.
  5. Shop - online shop run by the Seller at majoko.pl and majoko.eu.
  6. Contract concluded at a distance -
    an agreement concluded with the Customer as part of an organised system of concluding distance contracts (within the Shop), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the moment of conclusion of the agreement.
  7. Regulations - these regulations of the Store.
  8. Order - a declaration of will of the Customer submitted using the Order Form and aiming directly at concluding a Product Sales Agreement or Products with the Seller.
  9. Account - the customer's account in the Store, it collects data provided by the Customer and information about the Orders placed by him in the Store.
  10. Registration form – a form available in the Store enabling the creation of an Account.
  11. Order Form - an interactive form available in the Store enabling the placement of an Order, in particular by adding Products to the Basket and specifying the terms of the Sales Agreement, including the method of delivery and payment.
  12. Cart – an element of the Store software in which the Products selected by the Customer for purchase are visible, and it is also possible to determine and modify the Order data, in particular the quantity of products.
  13. Product – a movable item available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.
  14. Sales Agreement - a Product sales agreement concluded either
    concluded between the Customer and the Seller via the Online Store.

§ 4 Technical requirements

To use the Store, including browsing the Store's assortment and
To place orders for Products, you must:

  • a terminal device with access to the Internet and a current web browser such as Chrome, Safari, Firefox.
  • active e-mail account,
  • cookies enabled.


§ 5 General information

  1. The online store may only be used by persons over 18 years of age.
  2. The Seller provides services consisting in concluding online sales contracts for goods sold in the online store.
  3. Personal data provided by the Client for the purpose of registration
    to subscribe to the newsletter or make purchases in the online store are processed by the Seller in accordance with the principles contained in the Privacy Policy located on the online store's website.
  4. Providing personal data is voluntary, however, failure to provide the personal data required to conclude the Sales Agreement will result in the inability to conclude said agreement.
  5. The Seller shall not be liable, to the fullest extent permitted by law, for any disruptions, including interruptions in the functioning of the Store caused by force majeure, unauthorized actions of third parties or incompatibility of the Online Store with the Customer's technical infrastructure.
  6. Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment is possible either after creating an Account in accordance with the provisions of § 6 of the Regulations or by providing the necessary personal and address data enabling the execution of the Order without creating an Account.
  7. Prices listed in the Store are given in PLN and are gross prices (include VAT). It is possible to display the price in another currency (optional).
  8. The final (final) amount to be paid by the Customer consists of the price for the Product and the cost of delivery, about which the Customer is informed on the Store's website when placing the Order, including at the time of expressing the will to be bound by the Sales Agreement.
  9. In the event of shipping the Product outside the EU, additional customs duties or other taxes required by the regulations of the country to which the product is to be delivered may be charged. The Customer will be informed by e-mail about the need to incur additional costs. The Customer must agree to incur additional costs by sending a statement to the Seller's e-mail address in which he agrees to pay the additional costs. The Seller will complete the order when the Customer pays for the additional costs.


§ 6 Creating an Account in the Store

  1. To set up an Account in the Store, you must complete the Registration Form. The following data must be provided: first name, last name, e-mail address and a password assigned to the account.
  2. Setting up an Account in the Store is free. Logging in to the Account is done by entering the email address and password set in the Registration Form.
  3. The Customer may at any time, without giving any reason and without incurring any fees, delete the Account by sending an appropriate request to the Seller, in particular by e-mail or in writing to the address provided in § 3.

§ 7 Rules for placing an Order

To place an Order you must:

  1. Log in to the Store(optional);
  2. Select the Product that is the subject of the Order and then click the "Add to Cart" button (or equivalent);
  3. Log in or use the option to place an Order without registration;
  4. Complete the Order Form by entering the details of the Order recipient and the address to which the Product is to be delivered, select the delivery method, and select the payment method.
  5. Click the “Order and pay” button (or equivalent).
  6. Placing an Order by the Customer constitutes acceptance of the Regulations of the online store and constitutes a declaration of intent to conclude a Sales Agreement with the Seller, in accordance with its content.
  7. After placing the Order, the Customer receives an e-mail containing the final confirmation of all essential elements of the Order.
  8. The Agreement is deemed to have been concluded upon receipt by the Customer of the e-mail message referred to above.

§ 8 Delivery, payment and shipping

  1. The customer may use the delivery methods available on the electronic order form by selecting the appropriate option.
  2. Deliveries are subject to payment and are made worldwide, provided that the courier companies available in Poland serve the delivery address indicated by the Customer.
  3. The costs of delivery of the Product are indicated to the Customer when placing the Order, including when the Customer expresses his or her willingness to be bound by the Sales Agreement.
  4. Delivery time depends on the courier companies' delivery capabilities.
  5. Payment can be made in the manner selected at the time of placing the order on the electronic order form.
  6. Detailed information on delivery methods and acceptable payment methods can be found on the Online Store website.
  7. The shipping time should not exceed 2 working days, however, due to the handmade nature of the products, they require individual preparation time, therefore the delivery time may be longer.

§ 9 Right of withdrawal and returns

  1. The right to withdraw from the contract and return goods is granted to the consumer and the entrepreneur making a purchase of a non-professional nature.
  2. The Consumer and the Entrepreneur may withdraw from the Sales Agreement within 14 days without giving any reason.
  3. The consumer and the entrepreneur may return the goods within 14 days without giving a reason. The rules for withdrawal from the contract apply

  4. The period specified in paragraph 2 begins upon delivery of the Product to the Consumer, Entrepreneur or a third party indicated by him other than the carrier.
  5. The right to withdraw from the Agreement is exercised by submitting to the Seller an unequivocal declaration of withdrawal from the Agreement before the expiry of the 14-day period.
  6. The declaration of withdrawal from the contract may be submitted electronically by sending the declaration to the e-mail address provided in §3 or traditionally by sending the declaration in writing to the address provided in §3.
  7. If the declaration of withdrawal from the contract is submitted by a natural person running a sole proprietorship making a purchase of a non-professional nature, the Seller will verify whether the purchase made is of a non-professional nature for this person. Verification is carried out by analyzing the PKD codes indicated in the Central Register and Information on Economic Activity.
  8. The Seller is obliged to send the Consumer or Entrepreneur a confirmation of receipt of the declaration of withdrawal from the contract.
  9. In the event of withdrawal from the contract in Poland - the Consumer bears only the direct costs of returning the Goods (shipping costs). In the case of returns abroad, the customer bears the costs of return and all fees and customs duties related to it. The customer is obliged to deal with all formalities related to customs clearance.

  10. In the event that the Customer does not receive the Goods, which results in the return of the Goods to the Seller - the Seller may withdraw from the sales contract. Withdrawal from the contract is made by submitting a statement to the Customer in the form of an e-mail message.
  11. In the situation referred to in point 9, the Seller is obliged to immediately return to the Customer the payment received for the Goods purchased by the Customer.
  12. Consequences of withdrawal from the Agreement:
  • In the event of withdrawal from a Contract concluded at a distance, the Contract shall be deemed not to have been concluded.
  • In the event of withdrawal from the Agreement, the Seller shall immediately return to the Consumer, no later than within 14 days from the date of receipt of the declaration of withdrawal from the Agreement, all payments made by him, including the costs of delivering the goods, with the exception of additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest standard method of delivery offered by the Seller.
  • The Seller will refund the payment using the same payment method that was used by the Consumer in the original transaction, unless the Consumer has expressly agreed to another solution that will not involve any costs for him.
  • The Seller may withhold reimbursement until receiving the Product back or until proof of sending it back is provided, depending on which event occurs first.
  • The Consumer should return the Product to the Seller's address provided in these Regulations immediately, no later than 14 days from the day on which he informed the Seller of the withdrawal from the Agreement. The deadline will be met if the Consumer returns the Product before the expiry of the 14-day period.
  • The consumer bears the costs of returning the Product,
  • The Consumer is only liable for any reduction in the value of the Product resulting from using it in a manner other than necessary to establish the nature, characteristics and functioning of the Product.

13. The right to withdraw from a distance contract does not apply to the Consumer in relation to the Contracts listed in Article 38 of the Consumer Rights Act, in particular:

  • where the subject of the provision is a non-prefabricated item, manufactured according to the Consumer’s specifications or intended to meet their individual needs,
  • where the subject of the service is an item delivered in a sealed package which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery,
  • for the provision of services, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the commencement of the provision that after the Seller has performed the service, the Consumer will lose the right to withdraw from the Agreement,

in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the deadline for withdrawal from the Agreement expires.

§ 10 Complaint

  1. The Sales Agreement covers new Products.
  2. The Seller is responsible for physical and legal defects of the Product under the terms set out in the Civil Code.
  3. Complaints should be submitted in writing or electronically to the Seller’s addresses given in §3.
  4. In the complaint, the defect that the Buyer believes the goods have, the demands towards the Seller and, if possible, document the defect in question. The Seller is obliged to respond to the complaint within 14 days of its receipt. If the Seller does not respond within the aforementioned period, it is considered that the complaint has been accepted. The Seller shall provide the Buyer with the response to the complaint in writing or electronically.
  5. The seller will respond to the complaint request
    immediately, no later than within 14 days. If
    The seller will not respond to the complaint request
    within 14 days, it is considered that the Client's request has been accepted
    justified.


Goods returned under the complaint procedure should be sent
to the address given in § 3 of these Regulations.


If the Seller considers the complaint justified:
replacement and repair costs, including shipping costs related to
Complaints about the Goods are borne by the Seller.

§ 11 Extrajudicial methods of handling complaints and pursuing claims

The consumer has the following sample options:

The consumer is entitled to turn to a permanent amicable
consumer court referred to in Article 37 of the Act of 15
December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148,
as amended), with a request to resolve the dispute arising from
Agreement concluded with the Seller.


The consumer is entitled to apply to the provincial
inspector of the Trade Inspection, in accordance with Article 36 of the Act of 15
December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148,
as amended), with a request to initiate mediation proceedings in
regarding the amicable settlement of the dispute between the Consumer and
Seller.


The consumer can get free help in resolving the dispute
dispute between him and the Seller, also using the free
assistance of the district (municipal) consumer ombudsman or
a social organization whose statutory tasks include
consumer protection (including the Consumer Federation, the Association
Polish Consumers).
